We do not knowingly collect government identifiers (such as social security numbers), financial account numbers, or biometric identifiers, and we ask that you do not submit such data through free-text fields.
We collect information: (a) directly from you when you register, complete your profile, log oral habits, log foods, edit entries, complete surveys, or contact us; (b) automatically through your device and our servers when you use the Platform; (c) from your device’s camera, with your permission, when you scan barcodes or photograph food; and (d) from third-party food databases when matching your logged foods to nutritional information.

We are not a healthcare provider. In the United States, Smart Health Bite is not a “covered entity” or “business associate” under HIPAA, and data you submit to the Platform is generally not protected health information under HIPAA. It is instead protected under this Privacy Policy and applicable consumer privacy laws.

Nutritional information is sourced from third-party and governmental databases, including without limitation USDA FoodData Central, Open Food Facts, and Australian food composition databases. These databases are maintained by third parties; we do not control and cannot guarantee their accuracy, completeness, or currency. Nutrient values, ingredient lists, and product formulations change over time and may differ by country, batch, or labeling standard. All nutrient figures, pH estimates, and derived metrics shown on the Platform are estimates for general informational purposes only.
We are based in Canada and the United States, and your information may be processed and stored in Canada, the United States, and other countries where we or our service providers operate. Those countries may have data protection laws different from, and in some cases less protective than, the laws of your country.

The Platform automatically computes oral health percentages, nutrient totals, estimated pH values, sugar heat maps, trend charts, and personalized feedback based on the data you enter and third-party databases. This constitutes profiling for personalization purposes. These outputs:
You can influence the outputs by editing your entries, and you may contact us to ask questions about how a metric was calculated, to contest an output, or to request human review.
We send marketing emails or push notifications only where permitted by law and, where required (including in Canada under CASL, in the EEA/UK, and in the Middle East), only with your consent. Every marketing message includes an unsubscribe mechanism, and you can manage notification preferences in your account settings. Transactional and service messages (e.g., security alerts, policy updates) are sent regardless of marketing preferences.

In the event of a personal data breach, we will act in accordance with applicable law, including notifying the competent supervisory authority (e.g., within 72 hours where required by GDPR) and affected individuals where the breach is likely to result in a high risk to their rights and freedoms, or as otherwise required by the breach notification laws of your jurisdiction (including U.S. state laws, PIPEDA, and Middle East data protection laws).
We may update this Policy from time to time. The “Last Updated” date at the top reflects the latest version. For material changes — and in particular any change to our practices regarding the sale or sharing of personal information or the processing of health data — we will provide prominent notice (e.g., in-app notice or email) and, where required by law, obtain your fresh consent before the change applies to you. Continued use of the Platform after the effective date of a non-material change constitutes acceptance to the extent permitted by law.

These Terms & Conditions (“Terms”) are a binding agreement between you and Smart Health Bite (“Smart Health Bite,” “we,” “us,” or “our”), the operator of the NutriPH platform, with offices in Mississauga, Ontario, Canada and Greenwich, Delaware, United States. They govern your access to and use of the NutriPH website, mobile applications, waitlist, and related services (collectively, the “Service”).
By joining our waitlist, creating an account, or otherwise using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.
NutriPH is a wellness and nutrition-tracking platform that allows you to log foods (by barcode scan, photo, or manual entry), track oral hygiene habits, set nutrition targets, and view derived metrics such as nutrient breakdowns, estimated oral pH curves, oral health scores, sugar heat maps, glycemic load indicators, charts, survey feedback, and educational content. All such outputs are estimates generated from your inputs and third-party food composition data.
You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) to use the Service. By using the Service, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms. The Service is not directed to children, and we do not knowingly permit accounts for minors.
The Service is for general informational and wellness purposes only. NutriPH is not a medical device, diagnostic tool, or healthcare service, and Smart Health Bite is not a healthcare provider. The oral pH indicator, oral health percentages, sugar heat maps, daily scores, alerts, feedback, survey rationale, and all other outputs:
If you have a medical or dental condition, are pregnant, have an eating disorder or a history of disordered eating, or have any other health concern, consult a qualified professional before relying on any nutrition-tracking tool. If you experience a medical emergency, contact local emergency services immediately.
You agree to provide accurate registration information and to keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly at privacy@smarthealthbite.com of any suspected unauthorized use. We may suspend or terminate accounts that violate these Terms. You may have only one account, and you may not share, sell, or transfer it.
Joining the waitlist does not guarantee access to the Service, any particular launch date, or any particular features. Early-access and beta versions of the Service are provided for evaluation, may contain errors, may change or be discontinued without notice, and are provided “as is” to the fullest extent permitted by law.
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service for your own personal, non-commercial purposes. You may not, except as permitted by applicable law:
“User Content” means content you submit to the Service, including food logs, photos, hygiene logs, survey answers, comments, and community food database submissions (e.g., new foods with nutritional details).
The Service incorporates food composition data from third-party and governmental sources (including USDA FoodData Central, Open Food Facts, and Australian food composition databases) and may link to or interoperate with third-party services (including social media platforms). We do not control and are not responsible for third-party data, services, or websites, including their accuracy, availability, or privacy practices. Product formulations and nutrition data change over time and vary by region; values shown in the Service may not match the product in your hand.
If you choose to share content from the Service to social media or with other people, you do so at your own discretion and risk. Shared content may reveal information about your diet and health and may be copied or redistributed by others. Your use of any social media platform is governed by that platform’s own terms and policies.
The Service — including its software, design, text, graphics, logos, trademarks (including “NutriPH” and “Smart Health Bite”), models, algorithms, scores, and the compiled food database — is owned by Smart Health Bite or its licensors and is protected by intellectual property laws. Except for the limited license in Section 7, no rights are granted to you. Third-party data sources remain subject to their own licenses and attributions (e.g., Open Food Facts data is available under the Open Database License).
If you send us ideas, suggestions, or feedback about the Service, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use them without restriction or compensation to you.
Our collection and use of personal information is described in our Privacy Policy. By using the Service you acknowledge the Privacy Policy; where required by law, we will request your explicit consent (for example, for processing health-related data).
The Service is currently offered free of charge. We may introduce paid plans or features in the future; if we do, pricing and payment terms will be presented to you before you incur any charge, and these Terms will be updated accordingly.
We may add, modify, or remove features, content, or the Service itself at any time. We will endeavour to give reasonable notice of material changes that adversely affect you, but we are not liable for any modification, suspension, or discontinuation of the Service except where applicable law provides otherwise.
To the maximum extent permitted by applicable law, the Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, and uninterrupted or error-free operation. Without limiting the foregoing, we make no warranty regarding: the accuracy of nutrient values, pH estimates, scores, heat maps, or any other output; the completeness or currency of the food database; or that the Service will meet your requirements or expectations.

To the extent permitted by applicable law, you agree to indemnify and hold harmless Smart Health Bite and its affiliates, officers, employees, and agents from and against claims, liabilities, damages, losses, and reasonable expenses (including legal fees) arising out of or related to: (a) your User Content; (b) your violation of these Terms; (c) your violation of any law or the rights of a third party; or (d) your misuse of the Service. This Section does not apply to consumers in jurisdictions where such indemnities are unenforceable.
You may stop using the Service and delete your account at any time. We may suspend or terminate your access (with notice where required by law) if you breach these Terms, if required by law, or if we discontinue the Service. Upon termination, your license ends and Sections 8 (licenses already granted), 11, 12, 16, 17, 18, 20, and 21 survive. Deletion of your data following termination is governed by our Privacy Policy.
These Terms and any dispute arising out of or in connection with them or the Service are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules, and you and we submit to the exclusive jurisdiction of the courts of Ontario, sitting in Toronto — except that if you are a consumer habitually resident in a jurisdiction whose law grants you the non-waivable right to the protection of your local consumer law or to bring or defend proceedings in your local courts (including in the EU, the UK, Quebec, and certain U.S. states), nothing in this Section deprives you of that right. Before commencing any formal proceeding, you agree to first contact us at privacy@smarthealthbite.com and attempt in good faith to resolve the dispute informally for at least thirty (30) days.
